Many corporate legal teams view arbitration with skepticism-concerns about cost, fairness, efficiency, and enforceability often dominate the conversation. Yet arbitration remains a widely used mechanism for resolving commercial disputes, and its proponents argue that, when done right, it can be faster, more predictable, and less disruptive than litigation. This interactive program—offered by the Association of Commercial and Transactional ADR Professionals (ACT-ADR), a nonprofit network of dispute resolution and dispute prevention professionals who have served as senior executives and lawyers in multinational corporations and law firms—is designed for in-house counsel who have doubts about arbitration. ACT-ADR—together with leading organizations that administer domestic and international arbitrations and set the rules that govern them—will address your concerns firsthand: What frustrates you about arbitration? Where does it fall short? What would make it work better for your business? ACT-ADR participants will share their perspective about issues they faced while in your shoes, and—along with the arbitration administrators—will share how they are addressing, or can address, these issues through updated rules, streamlined processes, and innovations aimed at making arbitration simpler, more efficient, and timelier than court litigation.
