Amid rising global conflicts and East Asia tensions, US employers must confront uncertainty in recruiting worldwide talent, learning to balance dueling immigration regulations, employment and international trade laws, and recent anti-discrimination enforcement actions. Choose Your Own Adventure in this audience-led program, and work in teams to address challenging compliance issues, including the legality of employment restrictions tied to potential export control, the impact of future regulation changes on non-US workers, and anticipated legal shifts in these areas.

Clinton Yu

Barnes & Thornburg LLP

With nearly 14 years of experience, I advise clients on compliance with U.S. international trade and investment laws, including customs and import regulations, export controls (ITAR & EAR), economic sanctions (OFAC), and CFIUS.

My clientele, both domestic and foreign, seek my help in navigating the complex international trade issues affecting corporate and commercial transactions. I am also a strong advocate for them in dealing with U.S. government enforcement, whether in the context of investigations, penalties or voluntary disclosures.

I practice before the federal agencies that enforce U.S. international trade regulations, such as the U.S. Directorate of Defense Trade Controls (DDTC), Bureau of Industry and Security (BIS), Office of Foreign Assets Control (OFAC), and Customs and Border Protection (CBP).

My practice in the areas of customs and trade remedies includes Section 301 and Section 232 tariffs, antidumping and countervailing duties, country of origin, tariff classification, valuation, and free trade agreements. My export controls and sanctions experience is equally comprehensive and includes export classification, commodity jurisdiction, licensing, audits and monitorships.

I am frequently called upon in cross-border transactions to guide clients through import and export diligence, and in particular, through the various stages of national security reviews of foreign investment before the Committee on Foreign Investment in the United States (CFIUS).

Regularly speaking on trade and investment topics across the country and abroad, I have also been quoted in various publications throughout my career. In 2019, I was one of only a handful of attorneys in the U.S. recognized by Law360 as a Rising Star in International Trade.

Prior to joining Barnes & Thornburg, I practiced customs and international trade law in Houston, Texas, representing some of the largest energy companies in the world.
