United States litigations and government investigations involving international data is on the rise. The global scope of economic activity, and the incorporation of multi-national operations is no longer limited to large multi-national corporations. Due to remote workers and the adoption of a broader international workforce, US companies of all shapes and sizes are incorporating international employees within their business strategies and operations. This increase in scale and efficiency has created a surge in incidents involving cross-border and multi-language data transfers for US-based litigations, internal, and government investigations.  Companies are leveraging a wide range of new international technologies and applications to increase productivity while leveraging an ever-expanding global workforce to increase their international footprint. With this globalization of the US workforce, US-based companies and lawyers must deal with an ever-changing global market when collecting, reviewing, and producing international custodians’ data for US-based litigations and investigations. This session will address how to resolve the US eDiscovery challenges during collection, review, and data transfer of internationally located data for US matters. Discussion points will include:

Carolyn Bigg heads DLA Piper’s APAC Data, Privacy and Cybersecurity team.

Carolyn is an experienced data lawyer, focusing on China and APAC data compliance and international data transfers. Carolyn advises businesses on the best practice approach to navigating regional and international data privacy compliance, to help them seize opportunities to make the most of their data and digital opportunities in APAC within a compliant governance framework.  

Carolyn also has extensive experience of managing data incidents across the APAC region, including notifying affected individuals; reporting to privacy and industry regulators; responding to follow up regulatory investigations; liaising with forensic technology consultants, cyber insurers, and credit agencies; and supporting remediation and compliance programme update activities. Matt is the eDiscovery counsel and director of information retention counseling at Cooley, and he focuses on providing strategic guidance to clients in the areas of data and records retention, governance and compliance. His role involves developing and implementing policies and programs at the organizational level to ensure adherence to regulatory and legal requirements governing enterprise information.

Leveraging a wealth of experience, Matt offers practical and implementable solutions to address sophisticated data retention and discovery challenges. Collaborating closely with Cooley’s cyber/data/privacy team, Matt assists clients in crafting comprehensive and tailored information governance plans that emphasize best practices and consistent compliance. Additionally, Matt designs crucial corporate governance and compliance policies – such as those related to legal holds, short-form messaging, social media, mobile devices, permissible use and defensible deletion.

Matt’s experience extends to eDiscovery law, encompassing the management of electronically stored information in litigation. Matt is well versed in the legal and practical aspects of document retention, preservation practices, data collection, evidentiary review, and production. Frequently sought after for counsel on eDiscovery best practices, Matt plays a key role in implementing comprehensive eDiscovery readiness programs and playbooks for clients. Christopher Marks is a Senior Managing Director at Ankura based in Hong Kong SAR.

Chris has over 25 years’ accountancy experience, and has spent over 20 years in digital investigations with close involvement and oversight of complex cross-border litigation support, digital forensics, legal document review and FCPA investigations. Chris has carried out complex investigations to civil and criminal standards, with courtroom experience, utilising his understanding of the electronic evidence aspects of an investigation and applying relevant best practices. He is highly skilled in the project management of e-discovery engagements through all aspects of the Electronic Discovery Reference Model (EDRM) and helps clients respond to cybersecurity incidents using his many years of computer forensic experience.

Before joining Ankura in 2021, he was a Senior Managing Director and co-lead of the Asia technology practice at a major management consulting company having previously been Associate Partner at a Big Four accounting firm in Hong Kong.

Chris has worked on behalf of special committees and their independent counsel, management in internal investigations, monitors or compliance consultants pursuant to settlement agreements, and as a shadow investigator on behalf of a Big Four accounting firm’s audit practice. He has worked with companies in many industries, but most extensively in financial services, pharmaceuticals, oil & gas, mining, consumer and diversified industrial products, medical devices, and gaming.

His experiences of the various data laws and regulations across the Asia region enable him to provide expert advice to ensure compliance with the complex requirements of the many jurisdictions, in particular those of the People’s Republic of China.
