On June 5th at 10:00am EDT / 7:00am PDT, we will welcome Brandon M. Fitzgerald, Chief Legal Officer and Secretary, Board of Directors for the Special Olympics. For those not familiar, Special Olympics is a global sports movement for everyone that unleashes the human spirit through programming in sports, health, education and leadership, tackling the inactivity, stigma, isolation, and injustice that people with intellectual disabilities face. After receiving his B.A from the University of Pennsylvania and a J.D. from the University of Virginia, Mr. Fitzgerald began his career in private practice at law firms including Fried, Frank, Harris, Shriver & Jacobson LLP. He then went in-house at Choice Hotels and US Foods, then becoming Vice President, General Counsel, and Corporate Secretary of the Minority Corporate Counsel Association—a nonprofit dedicated to the promotion of diversity in the legal profession. He followed that with eight years at the United Negro College Fund (UNCF) before moving to the Special Olympics. Fitzgerald is active in the ACC as Membership Chair for the Nonprofit Organizations Network and as one of the Co-Chairs of the Corporate Scholars Program for the National Capital Region Chapter (ACC NCR), as a result . Since its inception in 2003, the Corporate Scholars Program has provided summer internships and awarded over $1.85M in stipends to almost 200 diverse law students. ACC NCR recognized him in 2019 for his service to the chapter.

Trade secret litigation in the United States has reached an inflection point: federal filings are at record levels, jury verdicts regularly exceed nine figures, and courts are simultaneously tightening the substantive and procedural requirements that plaintiffs must satisfy to prevail. This program will survey the most consequential trade secret decisions from the past year, including landmark rulings on pleading specificity, the “reasonable measures” requirement, damages apportionment, and the intersection of trade secret law with generative AI and employee mobility in the technology sector. Mr. Bush regularly represents software and technology companies in claims based on fraud, breach of contract, and negligence arising out of implementation problems, network design issues, software performance, and system compatibility problems. He has also represented employers and employees in disputes arising out of restrictive covenant agreements, misuse of confidential information, and violations of the Computer Fraud and Abuse Act. Mr. Bush routinely litigates trade secret disputes and he has particular experience in trade secret claims arising out of software development. He has appeared in numerous federal and state courts and is also experienced in arbitration.
