On May 14, 2026, the U.S. Supreme Court issued its anticipated decision in Montgomery v. Caribe Transport.  The case resolved a split among the federal circuits and lower federal and state courts as to whether federal preemption operates to shield freight brokers from negligence-based claims arising out of vehicular accidents.  The panelists for this session will review the decision, will discuss its implications for the transportation marketplace, and will explore a range of approaches currently emerging in the marketplace with respect to managing carrier selection and insurance programs in response to the decision.  Benesch’s Marc Blubaugh, author of the Transportation Intermediary Association’s amicus brief cited by Justice Kavanaugh during oral arguments and in the Court’s decision, will be joined by Justin Olsen, Chief Risk Officer – Liability & Casualty, LOGISTIQ Insurance Solutions, and Megan Johnson, Vice President of Legal & Risk, Axle Logistics.
