This presentation examines recent Federal Circuit decisions on software and AI patent eligibility and the USPTO’s seemingly contradictory policies favoring issuance of such patents. We will also examine likely district court and Federal Circuit outcomes when parties challenge the eligibility of software or AI patents issued under the USPTO’s recent policies. Finally, we will review pending legislation that would eliminate the “Alice” two-step patent eligibility test and expand eligibility beyond current judicial precedent.
