Oh, the Yates Memo. The bane of every in-house counsel’s existence. First it was born, then it was dead, then it was resurrected, and now it’s…dead again? In this engaging program, the CLE Performer, Stuart Teicher explores the meaning of the Yates Memo, the way it’s morphed over the years, and where it might be going in the future. Learning objectives include:

  • Understand the Yates Memo’s Core Principles: Examine the original intent of the Yates Memo and its focus on liability in corporate misconduct cases. Discuss Rule 1.13 issues; Rule 1.6 isues; privilege issues; issues regarding the formation of the attorney client relationship; Rule 2.1 issues.
  • Analyze Biden-Era Modifications: Explore how the Biden administration adapted the Yates Memo, including shifts in enforcement priorities and ethical considerations for legal practitioners.
  • Predict Trump’s Influence: Assess potential changes to the Yates Memo under Trump’s second term, based on past policies and current administration signals, and their implications for ethical practice.
